Terms of Service

These Terms of Service (“Terms”) govern your access to and use of DebtTracker, a platform operated by Skyline Financial (“Skyline,” “we,” “us”). By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use DebtTracker.

1. Eligibility & accounts

DebtTracker is available only to authorized Skyline Financial agents and staff who are at least 18 years old. You agree to provide accurate information, keep your login credentials confidential, and accept responsibility for all activity under your account.

2. Acceptable use

You agree to use the platform only for legitimate business purposes and in compliance with all applicable laws and regulations, including (without limitation) the FTC Telemarketing Sales Rule, the Fair Credit Reporting Act, and applicable debt-relief and consumer-protection laws. You will not:

• Use the platform to make false, misleading, or deceptive statements to any consumer;
• Access or attempt to access data you are not authorized to view;
• Copy, resell, reverse engineer, or interfere with the platform; or
• Upload unlawful content or violate the rights of others.

3. The tools are estimates, not advice

The calculators, breakdowns, and projections in DebtTracker — including minimum-payment and settlement figures, savings, timelines, and payment schedules — are estimates for illustration only, based on the inputs provided and general assumptions. They are not guarantees of results and are not financial, legal, tax, or credit-repair advice. Actual results depend on creditors, individual circumstances, and other factors. You are responsible for the accuracy of any figures you present to a consumer.

4. Your compliance responsibility

You are solely responsible for your own conduct and communications with consumers, including making all legally required disclosures and complying with all applicable laws. DebtTracker is a tool; using it does not make you compliant, and nothing within it constitutes legal advice.

5. Client data

You represent that you have the right to input any client information you enter and to use it as described. You agree to obtain any consents required by law (for example, before reviewing a consumer's credit report) and to handle client data lawfully.

6. Intellectual property

DebtTracker, including its software, design, and content, is owned by Skyline Financial and its licensors and is provided for your authorized use only. You may not copy, distribute, sublicense, or resell any part of it.

7. Availability

We aim to keep the platform available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any feature at any time.

8. Disclaimers

The platform is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and the accuracy or reliability of any calculation or projection.

9. Limitation of liability

To the maximum extent permitted by law, Skyline Financial and DebtTracker will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or revenues, arising from or related to your use of the platform. Our total liability for any claim will not exceed the amounts, if any, you paid to use the platform in the twelve months before the claim.

10. Indemnification

You agree to indemnify and hold harmless Skyline Financial and DebtTracker from any claims, losses, or damages arising out of your use of the platform, your communications with consumers, or your violation of these Terms or applicable law.

11. Termination

We may suspend or terminate your access at any time, including for any violation of these Terms. You may stop using the platform at any time.

12. Governing law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules.

13. Changes to these Terms

We may update these Terms from time to time. Your continued use of the platform after changes take effect means you accept the updated Terms.
